Terms of Service

BoulderCraft is a private beta route-setting tool for climbing gyms, provided by Charles Faso ("we", "us"). By requesting a beta key, entering it, or otherwise using BoulderCraft (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Beta Status

BoulderCraft is an unreleased beta product. It may contain bugs, may lose or corrupt saved data, may change substantially without notice, and may be discontinued at any time. Do not rely on it for anything critical. Back up any route data you care about.

2. Beta Access

Access requires a beta key issued by us. Keys are personal to the recipient, non- transferable, and may be revoked or expired at our discretion, including without notice. You are responsible for keeping your key confidential.

3. Acceptable Use

You agree not to:

Attempt to bypass the beta key gate or access the Service without a valid key
Reverse engineer, scrape, or interfere with the Service's operation
Use the Service to upload or transmit unlawful, harmful, or infringing content
Share your beta key with anyone not authorized by us

4. Feedback and Bug Reports

If you submit feedback or bug reports, you grant us a perpetual, royalty-free license to use that feedback to improve BoulderCraft, without any obligation to compensate you.

5. Intellectual Property

BoulderCraft, including its software, design, and content, is proprietary and owned by us. These Terms do not grant you any ownership rights. You may not copy, modify, distribute, sell, or reverse engineer any part of the Service except as permitted by law.

6. Disclaimer of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DATA WILL BE PRESERVED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED FIFTY US DOLLARS ($50).

8. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without notice. You may stop using the Service at any time.

9. Changes to These Terms

We may update these Terms as the Service evolves. Continued use after an update means you accept the revised Terms.

10. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.
